Finley death ruled "justifiable" homicide

BENTON COUNTY, WA. - A Finley man won't be charged with a crime for killing a family member a couple weeks ago. Prosecutors decided timothy Brown was only defending his grandfather.

It was determined to be a "justifiable" homicide. Brown shot a fellow family member who was fighting with the elderly grandfather. Jerry Barton was killed, who had a history of fights with family in the past.

"Under Washington State law, it is clear that Mr. Brown's actions were legally justified and probably were the actions that those of us at this table, probably would have taken under the same situation," said Benton County Prosecutor Andy Miller.

The 73 year old grandfather suffered numerous punches to the chest by Barton, but police say he is doing fine.
